How Long Will My Personal Injury Case Take? Insights from Eric Santoro, Connecticut Attorney

One of the most common questions I hear from clients is, "How long will my personal injury case take?" The answer, unfortunately, is not straightforward. Each case is unique, and several factors can influence the timeline of a personal injury case. As a personal injury attorney with over 20 years of experience practicing in Connecticut, I can provide some insights into the process and what you might expect.

Push pin on calendar, waiting for lawsuit to finish.

Factors Influencing the Timeline

  1. Severity of Injuries and Medical Treatment: The extent and severity of your injuries play a significant role in determining the length of your case. If your injuries require prolonged medical treatment or rehabilitation, it might take longer to reach a settlement because we need a complete understanding of your medical expenses and future care needs.
  2. Investigation and Gathering Evidence: A thorough investigation is crucial for building a strong case. This includes gathering medical records, police reports, witness statements, and other relevant evidence. Depending on the complexity of your case and the availability of evidence, this process can take several months.
  3. Negotiation with Insurance Companies: Insurance companies often engage in lengthy negotiations to minimize their payouts. While some cases can be settled quickly, others may involve prolonged back-and-forth negotiations to reach a fair settlement. Patience is key during this stage.
  4. Filing a Lawsuit and Pre-Trial Procedures: If a fair settlement cannot be reached, we may need to file a lawsuit. The pre-trial process involves several steps, including the discovery phase, depositions, and motions. Each of these steps can add to the overall timeline of your case.
  5. Court Schedules and Trial Dates: If your case goes to trial, the court’s schedule will influence the timeline. Court dates can be set months in advance, and trials themselves can take days or weeks, depending on the complexity of the case.

Typical Timelines for Personal Injury Cases in Connecticut

While each case is different, here are some general timelines to give you an idea of what to expect:

  • Simple Cases: These can sometimes be resolved within a matter of months, especially if liability is clear and the injuries are not severe.
  • Moderate Cases: Cases involving moderate injuries and some disputes over liability or damages can take anywhere from six months to a year to settle.
  • Complex Cases: Cases involving severe injuries, disputed liability, or significant damages can take one to two years or more to reach a resolution, and if a lawsuit is filed, another year or two.

It is important to remember that there is a two-year statute of limitations for negligence matters in Connecticut because it gives you a timeframe in which medical treatment would need to end and a case settled before a lawsuit would need to be filed.  If a lawsuit is filed, the length of time it takes to resolve or obtain a jury verdict can depend very much upon which Judicial District it is filed in.

Steps to Expedite Your Case

While some factors are beyond your control, there are steps you can take to help expedite your personal injury case:

  1. Seek Prompt Medical Attention: Ensure that you seek immediate and continuous medical treatment for your injuries. Keep detailed records of all treatments and follow your doctor's advice to document your recovery process accurately.
  2. Gather and Preserve Evidence: Collect as much evidence as possible from the accident scene and maintain thorough records of your medical treatments, expenses, and any communication with insurance companies.
  3. Stay in Communication with Your Attorney: Maintain regular contact with your attorney and provide any requested information promptly. Being responsive can help keep your case moving forward efficiently.
